IANAL, but Windows is already installed, so IMO this wouldn't apply. OOBE is not installation, it's setup.

Judge's verdict seems solid though.

IANAL, but consumers usually do have to finalize the installation, in particular activate the license online. From a legal perspective the technicality of a running kernel may not satisfy completion.
