The point is if you’re recording with a handheld device at least you can ensure there is some level of awareness to those around who can duck/signal they don’t want to be in it.

If it were made illegal then news journalism, documentary filmmaking, sports broadcasting (crowds), street photography, and police-body camera footage would become extinct almost overnight.
That’s already the case. Same question is why guns are regulated when killing someone is already illegal.
