A law passed without the representation of the people it is being enforced upon is no law at all. That is a founding principal of the United States. The ICC is not a representative organization and it cannot be. Therefore it has no right to enforce laws against the US or American people.

USA could decide war crimes are immoral and choose, like other nations, to not commit them and to be bound to a body that overseas that.

That is not lack of sovereignty, that is choice of morality.

Democracies can only enact the chosen rule of law because they're sovereign.
